Responsibilities for Reporting and Responding to Incidents of Sexual Harassment, Sexual Assault, or Sexual Violence

SECTION 1: CONFIDENTIAL RESOURCES

Only certain authorized confidential resources are authorized by law to maintain confidentiality. Therefore, if the victim wants to confidentially disclose information to an available confidential resource, members of the college community should immediately refer and/or provide the individual with the following list confidential resources:

Members of the college community should inform the victim that they are not authorized to maintain confidentiality before the individual shares information. Please note that college employees (faculty and staff) are not considered a confidential resource.

SECTION 2: REPORTING AND RESPONDING TO INCIDENTS (non-confidential reports)

Members of the college community who become aware of incidents of sexual harassment, sexual assault, or sexual violence, shall refer the individual to the college officials who are responsible for responding to incidents (see list under “Responding” below).

If the victim needs medical attention, refer her/him to:

If the victim is currently on the ESF campus, University Police can also provide medical assistance as well; contact them at 315-470-6666 (x6666 through campus phone).

REFERRING and REPORTING

Any member of the college community, whether faculty, staff, or students, who become aware of possible incidents of sexual harassment, sexual assault, or sexual violence, shall promptly refer the individual to one of the resources below, and report the incident to one of the individuals below as well. The staff in Centennial Hall, including RA’s, are considered members of the college community and are also responsible for reporting possible incidents of sexual harassment, sexual assault, or sexual violence to one of the individuals listed below. While members of the college community cannot maintain confidentiality (see Section 1 above), they should make every effort to maintain the privacy of the individual (e.g. do not discuss with other individuals other than those responsible for responding below, etc.)

RESPONDING

The individuals listed below, along with their designated staff, have an important responsibility and role in responding and providing resources to victims of sexual harassment, sexual assault, or sexual violence.

For complaints of student-to-student violations of the Code of Student Conduct, and complaints from an employee against a student:
